Terms, Policies and Conditions
Client acceptance of a proposal or estimate and/or paying a deposit or retainer from Cascade Pacific Woodworks implies agreement and acceptance of these policies.
Payment Overview
Structure above applies unless other arrangements have been agreed to in writing
Parties Involved
This Agreement is entered into between Cascade Pacific Woodworks (“Contractor”), whose principal place of business is located in Waterford CT, and the client (“Client”), whose name and address are specified in the project proposal and invoice. Both parties agree to the terms and conditions outlined herein regarding the design, construction, delivery, and installation of custom woodwork as described in the accompanying project documentation.
The Client affirms that they are authorized to enter into this Agreement and commit to fulfilling all payment and project obligations as specified. Cascade Pacific Woodworks, as the service provider, will perform the work in accordance with the agreed-upon project specifications and schedule.
Governing Law and Dispute Resolution
This Agreement shall be governed by and construed in accordance with the laws of the State of Connecticut. Any legal action or proceeding arising out of this Agreement shall be brought exclusively in the courts located in New London County, CT. Both parties agree to attempt mandatory mediation before filing any lawsuit.
Limitation of Liability (Damage Cap)
In no event shall Cascade Pacific Woodworks’ total liability for any claim, whether in contract, tort, or otherwise, exceed the total amount paid by the Client for the specific product at issue. This is a boutique service, and the Client assumes all risks beyond the purchase price.
Warrantees and Returns
Due to the custom nature of our work, all sales are final. The 15% restocking fee applies only to non-custom, ready-to-ship items (if applicable). Custom commissions are not eligible for return, credit, or refund under any circumstances.
Our products are warranted for life against any manufacturing error in accordance with these policies. Our items cannot be warranted against locations of extreme dryness or excessive humidity, both of which are beyond our control. We highly advise that our work is kept in conditioned spaces with relative humidity at 35%-55%. Products subject to abusive handling or care are not covered under our warranty. Failure to properly install, maintain, and protect Cascade Pacific Woodworks pieces will void the warranty. Cascade Pacific Woodworks reserves the right to qualify any claims on our products and does not include transportation or labor involved in claims towards our products.
Our 'Lifetime Warranty' refers to the functional life of the product while owned by the original purchaser. This warranty covers structural failures due to craftsmanship but excludes natural conditions and environments such as natural variations in wood color and texture, wood movement, or damage from environmental conditions outside the recommended 35%-55% relative humidity.

Safety and Intended Use
Products are designed for standard residential use only. Cascade Pacific Woodworks is not liable for injuries or damages resulting from use of the our products for purposes other than those for which it was designed (e.g., standing on tables, exceeding weight limits).
Designs, Drawings, and Plans
Cascade Pacific Woodworks reserves the right for measurement accuracy within 5% of the specified invoiced dimensions and to alter the product design to improve structural stability or address any unforeseen issues. Great consideration has gone into our designs to reduce the effects of warping; real wood products are hygroscopic in nature, meaning they will readily absorb and expel moisture from the atmosphere. Ambient changes in temperature and humidity can cause expansion or contraction in wood products. These dimensional changes may result in cracking, splintering, and/or warping, all of which are considered intrinsic risks of wood products and are not claimable defects. Cascade Pacific Woodworks recommends that interior products be kept in climate-controlled conditions not exceeding 50% relative humidity. Cascade Pacific Woodworks is not liable for any deformations while in the client’s possession.
As applicable:
Payment of the design retainer entitles the client to receive conceptual drawings and/or renderings.
Payment of the deposit entitles the client to receive any construction drawings and renderings
Final Design Approval and Project Commencement
Construction of any custom piece will not begin until the Client provides Final Design Approval. This occurs when the Client explicitly agrees to the final design package—which may include drawings, renderings, or written descriptions—and the final project price.
Methods of Approval: Approval may be communicated via email, text message, verbal confirmation, or signature on the final proposal. Any of these methods constitutes a binding agreement that the specifications are correct and the project is authorized to proceed to construction.
Design Finality: Once Final Design Approval is given, the design and price are considered locked. Cascade Pacific Woodworks relies on this approval to purchase specific materials and begin fabrication.
Post-Approval Changes (Change Orders): Any request for changes to the design, dimensions, or materials after Final Design Approval has been granted will require the project to re-enter the Design Phase. This will result in:
A potential revision of the final price to account for new materials or additional labor.
A rescheduling of the production and delivery timeline.
Additional design fees if significant new renderings or drawings are required
Cascade Pacific Woodworks reserves the right to decline requested changes if construction has progressed to a point where modification is no longer structurally or aesthetically feasible.
Client assumes responsibility for all shipping charges, setup, and delivery. Freight shipping will be set up by the buyer. Upon the client’s request for delivery, Cascade Pacific Woodworks shall deliver the products solely to the address specified by the client. The client is required to provide Cascade Pacific Woodworks with all pertinent details regarding the final delivery location, including but not limited to access points, potential obstructions, stairways, and any other conditions that could impede or affect delivery. Any discrepancies or defects in the delivered products must be reported immediately at the point of delivery. Once delivery is completed and accepted, Cascade Pacific Woodworks shall bear no further responsibility for the products.
Cascade Pacific Woodworks shall not be held liable for any damages incurred during the installation process, provided that such installation is performed in accordance with the agreed schedule and terms. All items requiring installation or assembly shall be completed during the scheduled delivery. Should any delays or construction at the client’s premises arise that are not attributable to Cascade Pacific Woodworks, the client shall be liable for a rescheduling fee equal to 1.5% of the total job cost. Furthermore, the client understands and accepts that no refunds shall be issued in instances where building materials, which may inherently affect the functionality of the installed product, are not specified.
Wood and Resin Coloration and Protection
Wood and resin will change color over time. Certain products and strategies can help slow down color changes, but the process cannot be stopped completely. The more ambient and unfiltered light wood and resin are exposed to, the faster the colors will change. Upon request, Cascade Pacific Woodworks can apply an finish that makes the piece more resistant to UV exposure. Coloration can also be affected by human interactions, such as wear and tear, spills, scratches or dents, exposure to chemicals, and improper care. Cascade Pacific Woodworks will provide client-specific care instructions for each delivered job.
Terms and Conditions
Merger/Entire Agreement Clause
These terms, along with the signed proposal, constitute the entire agreement between the parties. No prior discussions, emails, or oral representations shall be binding unless incorporated herein in writing.
Confidentiality
Both parties agree to treat all non-public information, drawings, designs, specifications, pricing, and trade secrets disclosed during this agreement as confidential. Such information shall not be shared or disclosed to any third party without the express written consent of the disclosing party, except as required by law or as necessary to fulfill contractual obligations. This obligation of confidentiality shall survive the termination or completion of this agreement.
Indemnification
The client agrees to indemnify, defend, and hold harmless Cascade Pacific Woodworks, its affiliates, employees, and agents from and against all claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising out of or in connection with the client’s misuse of the delivered products, failure to follow care instructions, or breach of this agreement. Cascade Pacific Woodworks shall not be liable for any indirect, incidental, or consequential damages related to the use or installation of its products.
Termination
Either party may terminate this agreement with written notice if the other party materially breaches any term of this agreement and fails to remedy such breach within 15 days of receiving written notice of the breach. Upon termination, the client shall pay for all work completed and materials purchased up to the date of termination. Any obligations regarding payment, confidentiality, and indemnification shall survive termination of this agreement.
