Policies and Conditions


Client acceptance of a proposal or estimate and/or paying a deposit or retainer from Cascade Pacific Woodworks implies agreement and acceptance of these policies.

Parties Involved

This Agreement is entered into between Cascade Pacific Woodworks (“Contractor”), whose principal place of business is located in Waterford CT, and the client (“Client”), whose name and address are specified in the project proposal and invoice. Both parties agree to the terms and conditions outlined herein regarding the design, construction, delivery, and installation of custom woodwork as described in the accompanying project documentation.

The Client affirms that they are authorized to enter into this Agreement and commit to fulfilling all payment and project obligations as specified. Cascade Pacific Woodworks, as the service provider, will perform the work in accordance with the agreed-upon project specifications and schedule.

Design Accuracies and Installed Conditions

Cascade Pacific Woodworks reserves the right for measurement accuracy within ±5 cm of the specified invoiced dimensions and to alter the product design to improve structural stability or address any unforeseen issues. Great consideration has gone into our designs to reduce the effects of warping; real wood products are hygroscopic in nature, meaning they will readily absorb and expel moisture from the atmosphere. Ambient changes in temperature and humidity can cause expansion or contraction in wood products. These dimensional changes may result in cracking, splintering, and/or warping, all of which are considered intrinsic risks of wood products and are not claimable defects. Cascade Pacific Woodworks recommends that interior products be kept in climate-controlled conditions not exceeding 50% relative humidity. Cascade Pacific Woodworks is not liable for any deformations while in the client’s possession.

Drawings, Plans, and Renderings

As applicable:

  • Payment of the design retainer entitles the client to receive conceptual drawings and/or renderings.

  • Payment of the deposit entitles the client to receive any construction drawings and renderings

Delivery & Installation

Upon the client’s request for delivery, Cascade Pacific Woodworks shall deliver the products solely to the address specified by the client. The client is required to provide Cascade Pacific Woodworks with all pertinent details regarding the final delivery location, including but not limited to access points, potential obstructions, stairways, and any other conditions that could impede or affect delivery. Any discrepancies or defects in the delivered products must be reported immediately at the point of delivery. Once delivery is completed and accepted, Cascade Pacific Woodworks shall bear no further responsibility for the products.

Cascade Pacific Woodworks shall not be held liable for any damages incurred during the installation process, provided that such installation is performed in accordance with the agreed schedule and terms. All items requiring installation or assembly shall be completed during the scheduled delivery. Should any delays or construction at the client’s premises arise that are not attributable to Cascade Pacific Woodworks, the client shall be liable for a rescheduling fee equal to 1.5% of the total job cost. Furthermore, the client understands and accepts that no refunds shall be issued in instances where building materials, which may inherently affect the functionality of the installed product, are not specified.

Wood and Resin Coloration

Wood and resin will change color over time. Certain products and strategies can help slow down color changes, but the process cannot be stopped completely. The more ambient and unfiltered light wood and resin are exposed to, the faster the colors will change. Coloration can also be affected by human interactions, such as wear and tear, spills, scratches or dents, exposure to chemicals, and improper care. Cascade Pacific Woodworks will provide client-specific care instructions for each delivered job.

Terms and Conditions

Confidentiality

Both parties agree to treat all non-public information, drawings, designs, specifications, pricing, and trade secrets disclosed during this agreement as confidential. Such information shall not be shared or disclosed to any third party without the express written consent of the disclosing party, except as required by law or as necessary to fulfill contractual obligations. This obligation of confidentiality shall survive the termination or completion of this agreement.

Indemnification

The client agrees to indemnify, defend, and hold harmless Cascade Pacific Woodworks, its affiliates, employees, and agents from and against all claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising out of or in connection with the client’s misuse of the delivered products, failure to follow care instructions, or breach of this agreement. Cascade Pacific Woodworks shall not be liable for any indirect, incidental, or consequential damages related to the use or installation of its products.

Termination

Either party may terminate this agreement with written notice if the other party materially breaches any term of this agreement and fails to remedy such breach within 15 days of receiving written notice of the breach. Upon termination, the client shall pay for all work completed and materials purchased up to the date of termination. Any obligations regarding payment, confidentiality, and indemnification shall survive termination of this agreement.

Return Terms

Upon the agreement of returned items, a 15% restocking fee will be applied. This includes, but is not limited to, the rejection of items upon initial delivery. The client is responsible for ensuring delivery in original condition.

Shipping

Client assumes responsibility for all shipping charges, setup, and delivery. Freight shipping will be set up by the buyer.

Photo Usage Policy

This Client Photo Usage Policy outlines the guidelines for using client-furniture photos for marketing and social media content.

Definitions

a. "Client" refers to any person or entity who has purchased and received our furniture products or services.

b. "Company" or "CASCADE PACIFIC WOODWORKS" refers to our organization, the furniture maker.

c. "Photos" refer to images, pictures, or photographs provided by the client or to the client, showcasing our furniture products.

Photo Submission and Ownership

a. Clients may voluntarily submit photos of furniture they have purchased from CASCADE PACIFIC WOODWORKS. By submitting these photos, clients acknowledge that they own the rights to the photos and grant the company permission to use them for marketing and social media purposes.

b. Clients understand that submitting photos does not transfer ownership of the photos to the company. Clients retain all copyright and intellectual property rights to their photos.

Use of Client Photos

a. CASCADE PACIFIC WOODWORKS may use client photos in marketing materials, including but not limited to:

i. Website and online product listings

ii. Social media posts and advertisements

iii. Email marketing campaigns

iv. Print materials such as brochures and catalogs

b. CASCADE PACIFIC WOODWORKS may make reasonable edits to client photos for clarity, quality, and branding purposes, but will not alter the fundamental context or integrity of the images.

Client Photo Attribution

CASCADE PACIFIC WOODWORKS will always make reasonable efforts to provide credit to the client for their photos, whenever possible, by mentioning the client's name, username, or other identifying information.

Client Rights and Withdrawal

Clients have the right to request the removal of their photos from any of CASCADE PACIFIC WOODWORKS' marketing and social media channels at any time. To do so, clients should contact us at info@cascadepacific-woodworks.com and provide details of the photos they wish to have removed.

Compensation and Consideration

Clients will not receive monetary compensation for allowing CASCADE PACIFIC WOODWORKS to use their photos. However, as a token of appreciation, clients who submit photos may be eligible for exclusive promotions, discounts, or other offers at the company's discretion.

Confidentiality

CASCADE PACIFIC WOODWORKS will not use client photos for any purpose other than marketing and social media content related to the company's products and services. The photos will not be sold, licensed, or shared with third parties for unrelated purposes.

Policy Updates

CASCADE PACIFIC WOODWORKS may update this Client Photo Usage Policy from time to time. Clients will be notified of any significant changes to the policy, and their continued use of our services after such changes will indicate their acceptance of the revised policy.

By submitting photos to CASCADE PACIFIC WOODWORKS, clients acknowledge that they have read and understood this Client Photo Usage Policy and agree to its terms and conditions. This policy ensures a collaborative and respectful approach to using client photos for marketing and social media content.
